If you were recently arrested or charged with a crime in Georgia, you might want to learn about your options. Our Smyrna criminal defense attorneys from Bader Law Injury Lawyers can help you navigate the justice system, get out on bail, or help reduce or drop your charges.

How Our Criminal Defense Attorneys Can Help You with Your Case in Smyrna

When you face the prospect of jail time, fines, and other consequences, our attorneys can help. We could build a defense for your case, such as the following:

  • The police violated your rights during the arrest.
  • The evidence in your case was not processed as required by law.
  • You did not possess a controlled substance.
  • You were acting out of self-defense.
  • There is a mistake of fact in your case.

If we argue for one or more of these defenses, we could get your charges dropped. Additionally, we might use other strategies to negotiate your charges or the consequences of a conviction.

Our Attorneys Can Build Your Defense

Our lawyers will work hard to build a compelling case for your defense when you hire our team. We can:

  • Investigate the details of your case
  • Gather our own evidence of what happened
  • Secure a release on bail or reduce your bail
  • Portray details of your personal background and argue for reduced charges or sentencing
  • Negotiate with prosecutors
  • Represent you at trial
  • Examine witnesses
  • Help to lower your fines and fees related to your case
  • Help you consider when to make a plea bargain

Do I Need an Attorney?

You may not yet be sure if it makes sense to hire a lawyer for your criminal case. Doing so can benefit you for many reasons, though.

  • The criminal court system in Smyrna is complicated. We can help you navigate the justice system efficiently, ensure that proper paperwork is filed, and represent you during the challenges of a court trial. Our team knows how to navigate the Smyrna Municipal Court and other area courts.
  • Potential negotiation of your charges or sentencing. Even if you feel that we could do little to drop your charges, we could still reduce your fines or sentencing. This could mean the difference between serving jail time and serving probation.
  • Support through the legal challenges of a criminal case. We understand local laws in Smyrna and Georgia, and our firm will bring our experience to your case. You don’t have to go through these legal challenges alone.

Conviction for a Criminal Charge Can Come with Serious Penalties in Georgia

A criminal charge could lead to serious consequences. If you’re convicted, you may face:

  • Fines
  • The prospect of jail time
  • Many consequences for your personal life (a harder time landing employment, finding housing, or securing loans)

Our criminal defense team understands criminal law in Georgia. Our lawyers serving Smyrna can help you avoid the most serious consequences of a criminal conviction, including the following:

Theft and Robbery

Theft in Georgia can include anything from breaking into a car with the intent to steal possessions to shoplifting. Penalties for theft range based on the context of the crime. For instance, stealing any item under $300 from a retail store is a misdemeanor in Georgia. However, multiple convictions can lead to house arrest, and a fourth conviction can lead to a felony charge and even jail time (O.C.G.A. § 16-8-14).

In Georgia, robbery refers to any forced theft in the physical presence of another person. This is a more serious charge. A conviction for robbery is punishable by up to 20 years in prison (O.C.G.A. § 16-8-40).

Controlled Substances

The sale or even possession of a controlled substance in Georgia, such as marijuana, can lead to significant consequences (O.C.G.A. § 16-13-30):

  • Possession or purchasing marijuana in Georgia can lead to a felony charge and between two to 15 years of prison time.
  • Delivery or sale of marijuana can lead to a felony charge and between five and 30 years in prison.

Subsequent convictions can come with higher penalties.

DUIs

In Georgia, you can receive an impaired driving charge if your blood alcohol content (BAC) behind the wheel is .08 or higher. This bar is even lower for young drivers – if you’re under 21, you can receive an impaired driving charge with a BAC of .02 or higher (O.C.G.A. § 40-6-391).

As with other crimes in Georgia, penalties for a DUI depend on the status of your prior convictions, among other factors:

  • A first offense can lead to fines ranging from $300 to $1,000, and up to a year in jail.
  • A second offense comes with a mandatory minimum jail time of 48 hours, which the court could extend to one year. The court would suspend the driver’s license for three years, and fine the driver between $600 to $1,000.

Additional penalties could apply for second convictions and beyond.

However, you don’t have to assume that you will receive the maximum fines and penalties listed here. If you hire a lawyer from our team, we could reduce the harshest consequences of these penalties.
